Student Park Permissive Use, Release, and Indemnity Agreement
In consideration of my voluntary use of the Student Park located at 10025 Park Lane, Collegedale TN (“Property”), on DATE, owned by Southern Adventist University, including the University and its governing boards, employees, and agents (“University”), I, for myself, personal representatives, heirs, spouse, successors, and assigns agree to the following Student Park Permissive Use, Release, and Indemnity Agreement:
- I specifically understand that the use of the Property is a privilege and agree to be responsible for any property damage to the Property that occurs as a result of my use of same. I agree that I will insure against damage to the Property and to supervise other participants with whom I may be associated to see that their use of the Property results in no damage to same. I will promptly report to university officials any damage that results from my use of the Property and will stop any of my activities which may result in property damage to the Property and/or personal injury to any person on or about the Property.
- I will contain and secure all trash in the cans provided and will replace cans with new liners kept at each can. Gate access is by request and may be used for off- and on-loading purposes at the pavilion. I agree to utilize marked parking spots (i.e. no parking on grassy areas). The University reserves the right to levy repair charges for damages to landscaping or any other part of the Property that may take place during reservation period.
- In consideration of the agreement of the University to allow the use the Property, I assumes all responsibility for any and all risks of property damage or bodily injury that I, my representatives and invitees may sustain while participating in any activities, demonstrations, exhibits, or events of any nature, including the use of the Property and any facilities on the Property. I understand that the use of the Property may involve known and unknown risks that may result in physical or emotional injury, paralysis, death, or damage to User or to third parties, or damage to or loss of User’s property or the property of third parties. I also understand that such risks cannot be eliminated and are inherent in the nature of the use of the Property. I am aware of these and other risks and hazards inherent in using the Property and voluntarily assumes sole responsibility for all such risks and hazards. I, on behalf of my heirs, executors, administrators, assigns, and anyone else entitled to sue on my behalf, hereby agree to release, waive, discharge, hold harmless, defend, and indemnify the University, its affiliates, promoters, sponsors, officers, owners, directors, employees, agents, vendors, and volunteers, (collectively the “Releasees”) of and from any and all claims, actions, lawsuits, causes of action, or losses for bodily injury, property damage, wrongful death, or otherwise that I may have against Releasees, including, without limitation, those that may arise out of my use of the Property. I further agree that all participants are under my direct and complete supervision, and the University has no responsibility in this regard. As such, I am liable for all damages incurred to any part of the University’s buildings, properties, facilities or equipment from the use of the Property by me or my participants. In addition, the terms and conditions of this agreement do not require the University to relinquish its control of its facilities, equipment and services to me. The University retains the right to require me or any of its participants to leave the University’s premises if the University determines that circumstances require it. The University assumes no responsibility for theft or loss of personal property, or damage to personal property of mine or any of my participants. The University assumes no liability whatsoever for any property placed by me in the University’s buildings, properties, or facilities.
I agree that this agreement is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee, and agree that, if any portion thereof is held invalid, the balance is to continue in full force and effect.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO ABIDE BY ALL THE TERMS OF THE FACILITY CONTRACT AGREEMENT. I FURTHER ACKNOWLEDGE THAT I HAVE CAREFULLY READ THE release of liability, assumption of risk, and indemnity CLAUSE and understand the contents thereof. I understand that by signing THIS I give up substantial rights I might otherwise have to recover damages for losses and sign it as my own free act.Client Responsibilities
Thank you for your support of the Student Park and related facilities at Southern Adventist University. To help ensure a safe and enjoyable experience for all guests, please review and comply with the following guidelines:
- Use of the Student Park is limited to the hours reserved and approved by your rental agreement.
- Parking or driving on the grass is strictly prohibited. Please use designated parking areas only. Southern Adventist University reserves the right to assess repair or replacement charges for any damage to buildings, structures, grounds, landscaping, or other university property resulting from facility use.
- All trash generated during your event must be properly contained and disposed of. Please use the trash bags in the cans and when they are full, tie the bags, and put them in the shed. Please not put loose trash or small bags in the shed.
- The cement pad at the pavilion may be used for loading and unloading only. Parking in this area is not permitted.
- Please remove all personal belongings, equipment, decorations, and event materials immediately following your reservation.
- Any damage or maintenance concerns should be reported promptly to 423.236.2814.
- Guests are expected to conduct themselves respectfully and courteously toward others using the park. Please report accidents, suspicious activity, loitering, or inappropriate behavior to Campus Safety at 423.236.2100.
- Southern Adventist University is a tobacco-free, alcohol-free, and drug-free campus. The possession or use of tobacco products, alcoholic beverages, illegal drugs, firearms, or fireworks is strictly prohibited anywhere on campus.
- All decorations, including balloons, strings, tape, signage, and related materials, must be removed and properly discarded after the event.
- Skateboards, rollerblades, bicycles, scooters, and similar equipment are not permitted in or around the pavilion area.
- No grills on tables as they cause damage.
- If tables are moved, please return them to their original locations.
- Inflatables of any kind are not permitted.
- Refunds are not available for canceled reservations. However, reservations may be rescheduled based on availability by contacting 423.236.2814.
- Rental of the Student park does not include climbing or repelling on the Goliath Wall. Those activities are reserved through the School of Health and Kinesiology, located in the Hulsey Wellness Center. You may reach them at 423.236.2850.
- In the event of an emergency, please contact Campus Safety immediately at 423.236.2100.
If your gathering is scheduled on Saturday, we kindly ask that you respect the Sabbath atmosphere observed on campus.
